  1. Overview Welcome to Pure Pantry & Care. The terms “we”, “us” and “our” refer to Pure Pantry & Care. We operate this online store and website (together, the “Services”) to provide you with a curated shopping experience. The Services are powered by Shopify. These Terms of Service (the “Terms”), together with any policies referenced herein (including our Privacy Policy and Refund Policy), govern your use of the Services. By accessing or using the Services you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

  2. Access and Account
    2.1 You warrant you are of legal age to form a binding contract in your jurisdiction, or you have parental/guardian consent for any minors using the Services on devices you control.
    2.2 To use the Services you may provide information (email, billing, payment, shipping). You represent that such information is accurate, current and complete and that you have all rights to use the payment methods supplied.
    2.3 You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Accounts are non-transferable.

    5.1 Prices, discounts and promotions may change without notice. The price charged is the price in effect when you place the order, shown in your order confirmation.
    5.2 Unless stated otherwise, prices exclude applicable taxes, shipping, customs and import charges.
    5.3 You agree to provide accurate, current payment and billing information and to promptly update it. By submitting payment details you warrant you are authorized to use the payment method.

  6. Shipping & Delivery
    6.1 Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events beyond our control.
    6.2 Risk of loss passes to you upon delivery to the carrier, unless otherwise required by law.

  7. Intellectual Property
    7.1 All content on the Services (text, images, logos, designs, audio, video) is owned by Pure Pantry & Care, its affiliates or licensors and protected by intellectual property laws.
    7.2 You may use the Services for personal, non-commercial purposes only. Reproduction, distribution, modification or other unauthorized use is prohibited without our prior written consent.
    7.3 Our trademarks and logos may not be used without permission.

  10. Relationship with Shopify
    10.1 Pure Pantry & Care is powered by Shopify. Sales you make on our Store are with Pure Pantry & Care.
    10.2 Shopify is not responsible for any aspect of transactions between you and Pure Pantry & Care. You release Shopify from claims arising from your purchases.

  11. Privacy
    11.1 Personal information we collect is governed by our Privacy Policy. Because the Services are hosted on Shopify, certain data is also processed by Shopify. 11.2 By using the Services you consent to the collection, transfer and processing described in our Privacy Policy.

  12. Feedback
    12.1 By submitting feedback, ideas or reviews (“Feedback”), you grant Pure Pantry & Care a perpetual, worldwide, sublicensable, royalty-free license to use, modify and exploit such Feedback for any purpose.
    12.2 You warrant you own the Feedback or have rights to grant these rights and that Feedback complies with these Terms.

  13. Errors, Inaccuracies & Omissions
    13.1 We may correct errors, inaccuracies or omissions and change or update information, or cancel orders if information is inaccurate, even after order submission.

  14. Prohibited Uses
    14.1 You agree not to use the Services for unlawful purposes, to infringe third-party rights, to transmit malware, spam, or to scrape or otherwise harvest data. 14.2 Use of automated agents (bots) or AI tools to access the Services is prohibited unless expressly permitted.
    14.3 We may suspend or terminate accounts that violate these Terms.

  15. Agents
    15.1 Applicability. This section applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. “Agent” means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person’s device, without direct supervision.

  16. Termination
    16.1 We may suspend or terminate your access to the Services at any time for any reason.
    16.2 Termination does not relieve you of amounts owed. Sections that by nature survive termination (e.g., Intellectual Property, Feedback, Disclaimer, Limitation of Liability, Indemnification, Governing Law) remain in effect.

    17.1 THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
    17.2 WHERE APPLICABLE LAW DOES NOT ALLOW DISCLAIMER OF IMPLIED WARRANTIES, SUCH IMPLIED WARRANTIES MAY APPLY.

  18. Limitation of Liability
    18.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, PURE PANTRY & CARE AND ITS AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS AND SHOPIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS.

  19. Indemnification
    19.1 You agree to indemnify, defend and hold harmless Pure Pantry & Care, Shopify and their affiliates and service providers from claims, losses, liabilities and expenses (including reasonable attorney fees) arising from (i) your breach of these Terms, (ii) your violation of law or third-party rights, or (iii) your use of the Services.

  20. Severability
    20.1 If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

  21. Waiver; Entire Agreement
    21.1 Failure to enforce a right is not a waiver. These Terms and incorporated policies constitute the entire agreement between you and Pure Pantry & Care regarding the Services.

  22. Assignment
    22.1 You may not assign your rights or obligations without our prior written consent. We may assign or transfer these Terms without notice.

  23. Governing Law
    23.1 These Terms are governed by the laws and courts in the jurisdiction where Pure Pantry & Care is headquartered. You and Pure Pantry & Care consent to personal jurisdiction and venue in those courts.

    24.1 Headings are for convenience and do not affect interpretation.

    25.1 We may update these Terms at our discretion. Material changes will be notified in accordance with applicable law. Continued use after changes constitutes acceptance.
